LGPD CHANNEL
The General Data Protection Law (LGPD), established by Law No. 13,709 of August 14, 2018, is the Brazilian legislation that regulates the processing of personal data. Its purpose is to protect the fundamental rights of freedom, privacy, and the free development of an individual’s personality, establishing clear guidelines on how personal data should be collected, stored, processed, and shared by individuals and legal entities, both public and private, operating within national territory.
Objective: To regulate the processing of personal data and protect the rights of freedom, privacy, and the free development of an individual’s personality.
Personal Data: Any information related to an identified or identifiable individual, including sensitive data such as racial or ethnic origin, religion, political opinions, sexual orientation, and health.
Data Subject: The natural person to whom the personal data refers.
Recipients: Natural and legal persons, public and private, who process personal data of individuals in Brazil for offering goods, services, or data commercialization.
Data Processing: Includes operations such as collection, recording, organization, consultation, disclosure, sharing, storage, and deletion.
Regulatory Body: National Data Protection Authority (ANPD).
Effective Date: September 2020.
Principles of Data Processing (Article 6):
Purpose: Data processed for a specific purpose informed to the data subject.
Adequacy: Processing compatible with the purposes informed.
Necessity: Minimum processing necessary for the intended purpose.
Free Access: Guarantee of access for data subjects to their data.
Data Quality: Accuracy and updating of personal data.
Transparency: Clear and accessible information about data processing and its purposes.
